Section 01Who We Are

This Privacy Policy applies to the website agentkelner.com (the "Site"), operated by Mark Kelner, a Licensed Real Estate Broker in the State of Illinois affiliated with United Realty Group (collectively, "we," "us," or "our").

Mark Kelner is licensed by the Illinois Department of Financial and Professional Regulation (IDFPR), Division of Real Estate, and is a member of the North Shore Barrington Association of Realtors (NSBAR). The brokerage operates under and is subject to the Illinois Real Estate License Act of 2000, the National Association of Realtors® Code of Ethics, the Fair Housing Act, and applicable federal and state privacy laws.

Section 02Information We Collect

2.1 Information you provide directly

When you contact us, request a consultation, submit the lead form, or request a market report, we collect:

• Identifiers: name, email address, phone number
• Transaction interest: buying budget, estimated home value, neighborhood of interest, timeline, intent (sell, buy, both, invest)
• Free-text content: messages, notes, situation specifics, and any other information you choose to share in form fields
• Calendly bookings: if you book a strategy call via Calendly, Calendly collects your name, email, time-zone, and any answers to their intake questions. See the Calendly Privacy Policy.

2.2 Information collected automatically

When you visit the Site, we (and our third-party service providers) automatically collect:

• Device & browser data: IP address, browser type and version, operating system, device type, screen size, language preference
• Usage data: pages viewed, time on page, scroll depth, click events on phone/text/email links, referring URLs, exit pages
• Behavioral analytics: page views, lead-form submissions, and contact-link clicks tracked by Google Tag Manager (GTM), Google Analytics 4 (GA4), and Meta (Facebook) Pixel
• Server logs: standard web-server access logs maintained by our hosting provider (Netlify), including IP addresses and timestamps
• Browser storage: sessionStorage values used to remember if you've seen the intro animation or dismissed the floating Calendly invitation (these clear when you close your browser tab)

2.3 Information from third parties

We may receive information about you from:

• Public sources: publicly available data (e.g., Zillow review profiles, social media handles you have made public)
• Multiple Listing Service (MLS): property and transaction data relevant to your real estate needs, accessed under our brokerage's MLS membership
• Referral partners: if another agent, attorney, lender, or past client refers you to us

2.4 Information we do NOT collect

We do not collect Social Security numbers, full bank account numbers, or government-issued ID numbers through this Site. Sensitive financial information required for a real estate transaction (such as loan applications) is collected by your lender, attorney, or title company under their own privacy policies.

Section 03How We Use Your Information

We use the information we collect to:

• Respond to your inquiries and provide real estate brokerage services
• Deliver custom market reports, property recommendations, and consultation follow-up
• Communicate with you by phone, text message, or email about your transaction or general market updates (with your consent)
• Improve the Site's content, design, performance, and conversion paths
• Measure marketing campaign performance and optimize advertising spend
• Comply with legal, regulatory, and professional licensing obligations
• Detect, prevent, and respond to fraud, abuse, or security incidents
• Enforce our terms of service and protect our legal rights

We do not sell your personal information. We do not rent or trade your personal information to data brokers.

Section 04Legal Bases for Processing

Where required by law (including the EU's GDPR or similar frameworks), we rely on the following legal bases to process your personal information:

• Consent: when you submit a form, opt in to text messaging, or accept cookies
• Contract: when processing is necessary to provide brokerage services you have requested
• Legitimate interests: for routine analytics, fraud prevention, and direct communication with prospects who have voluntarily contacted us
• Legal obligation: compliance with real estate licensing, anti-money-laundering, and tax-reporting requirements

Section 05How We Share Information

We share personal information only as needed and in the following circumstances:

• Service providers who help operate the Site or our brokerage (hosting, form-submission processing, analytics, advertising platforms, calendar scheduling, email delivery). These providers are contractually limited to using your information only to perform services for us.
• Transaction partners when you authorize us to share information with attorneys, lenders, inspectors, title companies, contractors, or other professionals required to complete your real estate transaction.
• Brokerage and MLS with United Realty Group and the relevant Multiple Listing Service as required by our brokerage agreement and Illinois real estate law.
• Legal compliance when required by a valid subpoena, court order, regulatory request, or other legal process, or to investigate suspected fraud or illegal activity.
• Business transfer in the event of a merger, acquisition, brokerage transfer, or sale of business assets.
• With your consent for any other purpose disclosed to you at the time of collection.

Section 07Cookies & Tracking Technologies

This Site uses cookies and similar technologies to operate, secure, and analyze the user experience. The main categories are:

• Strictly necessary: required for the Site to function (e.g., session cookies, security tokens). These cannot be disabled.
• Analytics: Google Analytics 4 (via GTM) measures aggregated traffic and behavior. IP addresses are anonymized where supported.
• Advertising: Meta Pixel records actions you take on the Site to enable conversion measurement and lookalike-audience modeling for Meta-network advertising.
• Functional: sessionStorage values remember small UI state (intro animation, floating-CTA dismissal) for the duration of your browser tab.

How to control cookies. Most browsers let you block or delete cookies and clear local/session storage. Mobile devices allow you to reset or limit advertising identifiers. Disabling cookies may affect functionality. For Google Analytics specifically, you can install the Google Analytics Opt-Out Browser Add-On. For Meta advertising preferences, visit your Meta ad settings.

Section 08SMS & Email Communications

8.1 Text messaging (TCPA compliance)

By submitting your phone number through our forms or by initiating a text conversation with us, you expressly consent to receive text messages from Mark Kelner regarding your inquiry and related real estate matters. Standard message and data rates may apply. Message frequency varies. You may opt out at any time by replying STOP to any text message. You may reply HELP for assistance. We do not use auto-dialers for marketing.

This consent is not a condition of any purchase or service. If you do not want to receive text messages from us, you may use email or phone instead.

8.2 Email (CAN-SPAM compliance)

If we send you marketing emails (such as market reports or neighborhood updates), you may unsubscribe at any time using the link at the bottom of any email or by replying with "unsubscribe." Transactional emails (such as responses to your direct inquiries or closing-related correspondence) are not subject to opt-out under federal law.

Section 09Data Security

We use commercially reasonable administrative, technical, and physical safeguards to protect personal information, including:

• HTTPS encryption in transit (TLS) for all Site traffic
• Reputable third-party service providers with documented security programs
• Access controls limiting who within the brokerage can view personal information

No method of transmission or storage is 100% secure. In the event of a security breach affecting Illinois residents' personal information, we will provide notification consistent with the Illinois Personal Information Protection Act (815 ILCS 530).

Section 10Data Retention

We retain personal information only as long as necessary to fulfill the purposes for which it was collected, including:

• Inquiry & lead data: retained for up to 7 years from the last interaction, to support ongoing real estate relationships and required record-keeping
• Transaction records: retained as required by the Illinois Real Estate License Act and brokerage policy (typically 5+ years post-closing)
• Analytics data: Google Analytics retention is set per Google's defaults; aggregated reports are retained indefinitely in non-identifying form
• Marketing opt-out lists: retained indefinitely to honor your opt-out preferences

Section 11Your Privacy Rights

Depending on your state of residence, you may have rights under applicable privacy law to:

• Access: Request a copy of the personal information we hold about you
• Correct: Request correction of inaccurate personal information
• Delete: Request deletion of your personal information, subject to legal retention exceptions
• Opt out: Opt out of targeted advertising or the sale/sharing of personal information (we do not sell personal information)
• Portability: Receive a copy of your data in a portable format
• Non-discrimination: Not be discriminated against for exercising privacy rights

To exercise any of these rights, email mark@united.re or call (847) 899-9970. We may need to verify your identity before fulfilling certain requests. We will respond within the timeframes required by applicable law (typically 30–45 days).

Section 12California Residents (CCPA / CPRA)

If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), provides you with the rights listed in Section 11 above, plus the right to limit the use of sensitive personal information. The categories of personal information we collect are described in Section 2.

Categories disclosed for a business purpose in the past 12 months: identifiers (to service providers for hosting, analytics, form processing, and advertising attribution). Categories sold or shared: none. Sensitive personal information: we do not collect or use sensitive personal information beyond what is necessary to provide our services.

To submit a verifiable consumer request, contact us using the methods in Section 21. You may also designate an authorized agent. If you are unsatisfied with our response, you may file a complaint with the California Privacy Protection Agency.

Section 13Residents of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and Other States

If you reside in a state with a comprehensive consumer privacy law (such as Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Iowa, Tennessee, Indiana, New Jersey, Delaware, New Hampshire, Maryland, Minnesota, Kentucky, Rhode Island, or others as they take effect), you have the rights described in Section 11. You may also have the right to appeal a refused request. Contact us at the address in Section 21 to exercise these rights. We do not process personal information for purposes of "profiling" that produces legal or similarly significant effects.

Section 14Illinois Residents

If you are an Illinois resident, the following Illinois laws may apply to our handling of your personal information:

• Illinois Personal Information Protection Act (815 ILCS 530): requires notification in the event of a security breach affecting unencrypted personal information.
• Illinois Biometric Information Privacy Act (BIPA): we do not collect biometric identifiers (fingerprints, facial geometry, voiceprints, etc.) through this Site.
• Illinois Consumer Fraud and Deceptive Business Practices Act: we commit to truthful representation in marketing and brokerage services.
• Real Estate License Act of 2000 (225 ILCS 454): governs the licensed real estate services Mark Kelner provides through United Realty Group.

Section 15International Visitors (EU, UK, & Outside the United States)

The Site is operated from the United States and is intended for visitors interested in Illinois real estate. If you access the Site from outside the United States, your information will be transferred to and processed in the United States. By using the Site, you consent to such transfer and processing. We rely on the legal bases listed in Section 4 for European-resident data, and you may exercise the rights listed in Section 11.

Section 16Children's Privacy

This Site is not directed to children under the age of 16, and we do not knowingly collect personal information from children. If you believe a child has provided personal information through the Site, please contact us at mark@united.re and we will delete it promptly.

Section 17Real Estate Professional Disclosures

Licensing. Mark Kelner is a Licensed Real Estate Broker in the State of Illinois (IDFPR) and operates under United Realty Group. All real estate services are provided in compliance with the Illinois Real Estate License Act of 2000, the National Association of Realtors® Code of Ethics, and the rules of the North Shore Barrington Association of Realtors (NSBAR).

Buyer Agency. As of August 17, 2024, the National Association of Realtors® settlement requires that a written Buyer Agency Agreement be executed before a real estate professional shows you a property. Mark Kelner enters into such agreements with buyer clients as required by law.

Information accuracy. Property information displayed on this Site (whether from MLS, public records, or other sources) is deemed reliable but not guaranteed. Square footage, lot size, taxes, school assignments, and similar details should be independently verified by you and your professional advisors before relying on them in a transaction.

Fair Housing. Mark Kelner and United Realty Group comply with the Federal Fair Housing Act (42 U.S.C. § 3601 et seq.) and the Illinois Human Rights Act (775 ILCS 5). We do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, sexual orientation, gender identity, marital status, age, ancestry, military status, or any other class protected by federal, state, or local law.

Section 18Equal Housing Opportunity

This Site and Mark Kelner Real Estate fully support the principles of the Equal Housing Opportunity Act. All real estate advertised is available to qualified purchasers on a non-discriminatory basis.

Section 19"Do Not Track" Signals & Global Privacy Control

The Site does not currently respond to "Do Not Track" (DNT) browser signals, as no industry consensus exists for how to interpret them. We do respect Global Privacy Control (GPC) signals where required by law (e.g., for California residents) by treating them as a valid opt-out of the "sale" or "sharing" of personal information — although we do not sell personal information in any case.

Section 20Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Material changes will be announced through prominent notice on the Site or by direct communication. Your continued use of the Site after changes take effect constitutes acceptance of the updated policy.
